The Mazi Nnamdi Kanu Global Defence Consortium (GDC) has declared that the case against detained IPOB leader, Mazi Nnamdi Kanu, is legally “dead and buried,” insisting that no Nigerian court has jurisdiction to retry him.
In a statement signed by human rights lawyer Njoku Jude Njoku, Esq., on October 14, 2025, the GDC faulted those questioning the ongoing protests led by activist Omoyele Sowore, arguing that Kanu’s case was conclusively terminated by the Court of Appeal judgment delivered on October 13, 2022.
“The case is not in court — it’s in the grave,” Njoku said, citing the Supreme Court decisions in Madukolu v. Nkemdilim (1962) and Abacha v. State (2002) to support the argument that once jurisdiction collapses, the entire proceedings die instantly. “Any judge pretending otherwise is dancing on the corpse of the law,” he added.
He further invoked Section 36(9) of the 1999 Constitution, which prohibits double jeopardy, insisting that “any attempt to retry Kanu is a constitutional violation.” Njoku also noted that the Terrorism Prevention Act 2013, under which Kanu was initially charged, was repealed in 2022 — rendering the legal foundation of the case invalid.
The statement also touched on international dimensions of the matter, describing Kanu’s 2021 arrest in Kenya as an “illegal abduction” rather than a lawful extradition. Njoku said this breach of international law would likely expose Nigeria to sanctions once the ECOWAS Court delivers its verdict.
Defending Sowore’s planned march, the GDC said it was an act of “righteous resistance,” not recklessness. “The DSS and their handlers fear one thing: public pressure backed by law and conscience,” Njoku said, accusing “government-sponsored writers” of trying to discredit the movement.
He also criticized Justice James Omotosho of the Federal High Court, Abuja, describing the proceedings before him as “a legal ghost.”
“The real criminals,” Njoku concluded, “are those ignoring finality, double jeopardy, and the Constitution itself. Madukolu buried this case. Abacha sealed it. Section 36(9) locked the coffin. No propaganda or puppet judge can open it again.”
